The unique nature of the construction industry — involving high risks and significant capital investment — demands proper contract management to achieve intended results in terms of cost, time, quality, and scope. Understanding the fundamentals of contracts, defining parties’ rights and obligations, forming contracts, and managing them from inception to completion (and even beyond, until discharge) is vital.

This program covers all aspects related to the administration of a contract, including procedures, timelines, consequences, and principles governing commencement, suspension, and termination. It also addresses variation procedures, dealing with omissions and loss of profit, and applying value engineering — recognizing that change is inevitable in the construction industry.

As cash flow is often referred to as the lifeblood of a construction project, the program explores, in depth, all types of payments: advance payments, interim payments, retention money, and final accounts, including material-on-site and off-site payments to support healthy cash flow.

The program also addresses risk management, covering various types of insurance, their purposes, key terminology, claim mechanisms, and force majeure events with their consequences — acknowledging the inherently high-risk nature of the industry.

Recognizing that disputes are common in the construction industry, the program dedicates a full session to strategies for prevention, different dispute resolution mechanisms, and an in-depth look at arbitration.

Finally, it examines types of delays, parties’ entitlements, grounds for extensions of time (EOT), and the preparation of claims for acceleration costs, idling costs, and prolongation costs.
